These Terms and Conditions apply to the Alya app (hereinafter referred to as "Application") for mobile devices that was created by Ali Yapici (hereinafter referred to as "Service Provider") as a Freemium service.

By downloading or using the Application, you agree to be bound by these Terms and Conditions. Please read them carefully before using the Application. Unauthorized copying, modification, or distribution of the Application, any part of it, or our trademarks is strictly prohibited. Any attempts to extract the source code, translate the Application into other languages, or create derivative versions are not permitted. All trademarks, copyrights, database rights, and other intellectual property rights related to the Application remain the property of the Service Provider.

The Service Provider is committed to ensuring that the Application is as useful and efficient as possible. Therefore, we reserve the right to make changes to the Application or to charge for its services at any time and for any reason. We will never charge you for the Application or its services without making it very clear to you exactly what you're paying for.

We value your privacy and are committed to protecting your personal data. Please refer to our Privacy Policy for detailed information on how we collect, use, and protect your information.

The Application collects and processes personal data that you provide to us, including but not limited to:

• Profile picture

• Personalize your user experience within the Application
• Display your profile information

The Application utilizes artificial intelligence technologies to generate content and responses. While we strive to ensure the quality and appropriateness of the AI outputs, we cannot guarantee that all generated content will be accurate, reliable, or free from errors. Users should be aware that AI-generated content may occasionally produce unexpected or unintended results.

By using the Application, you acknowledge and agree that:

• The AI outputs are generated automatically and may not have been reviewed by a human.
• You will use the AI-generated content responsibly and at your own risk.
• We are not liable for any loss or damage resulting from your reliance on AI-generated content.

You are responsible for ensuring that your use of the Application complies with all applicable laws and regulations. You agree not to use the Application to generate content that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable.

We are committed to protecting your personal data and implement appropriate technical and organizational measures to safeguard it against unauthorized access, alteration, disclosure, or destruction.

We retain your personal data only for as long as is necessary for the purposes set out in these Terms and Conditions. When your personal data is no longer required, we will delete it securely.

The Application is not intended for use by individuals under the age of 13. We do not knowingly collect personal data from children under 13. If we become aware that we have collected personal data from a child under 13, we will take steps to delete such information promptly. In no event shall the Service Provider be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation loss of profits, data, use, goodwill, or other intangible losses, resulting from:

• Your access to or use of or inability to access or use the Application
• Any conduct or content of any third party on the Application
• Any content obtained from the Application, including AI-generated outputs
• Unauthorized access, use, or alteration of your transmissions or content

This EULA is a legal agreement between you and the Service Provider governing your use of the Application. By downloading or using the Application, you agree to be bound by the terms of this EULA. If you do not agree to the terms, do not download or use the Application.

The Application is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied. We do not warrant that the Application will be uninterrupted or error-free, and we are not responsible for any content or information accessed through the Application, including AI-generated content.

These Terms and Conditions are governed by and construed in accordance with the laws of your jurisdiction, without regard to its conflict of law provisions.

We may update these Terms and Conditions from time to time. Therefore, you are advised to review this page periodically for any changes. We will notify you of any significant changes by posting the new Terms and Conditions on this page and updating the "Effective Date" below.

These Terms and Conditions are effective as of 2024-10-28.

By using the Application, you consent to these Terms and Conditions now and as amended by us.
